Noisy Tenant live downstairs?

We are the landlord of a 3 level apartment and we don't live there. The tenants living in the upper level complain about the tenants living in the middle level playing video games day and night. We spoke to those teenagers about it, and they denied it, their parents denied it as well. If those kids play games in the mid night loudly, how come their parents can still sleep well?



The tenants living in the first floor never ever bring up the issue, they used to be the most sensitive tenants, but this time, they say nothing about it.



The couple living in the upper level is not the type of 9 to 5 office worker, who stay home often.



My question is, is it possible that the noise of playing video games could be that loud? And, as the landlord, what should we do?

Could the noise from video games be that loud? Yes, it can be. I lived upstairs from some college students who kept their t.v. up pretty loud when they played video games, and I could hear every word and sound. It does seem unlikely to me, however, that the upstairs neighbors can hear it if the downstairs neighbors don't. Have you asked the downstairs neighbors whether they can hear the noise or not? If you haven't, I would ask them. If they can hear the noise and just haven't complained about it, it is the word of two tenants versus the word of one tenant. What you can do about the situation depends on the terms in the lease. Assuming the lease states that they not disturb their neighbors. . .you need to send them a letter of warning telling them to keep the noise down or risk breaching the lease agreement. If the noise continues after that, you will have to start eviction proceedings.
